Will a United States FDA Decision on E Cigarettes open a Can of Worms?

The E Cigarette community in the United States is awash with rumours that a decision on the future fate of E Cigarette sales and usage in the country is near, and general consensus seems to be that all relevant paperwork in the case presented by the FDA is ready and that a federal judge has made a final decision ? a decision that will be announced imminently.
If a potential ban on the devices does come into effect, an issue relating to black market sales may come to the forefront, and this may be a problem that the FDA has not taken into consideration before looking for a ban to be put in place. One of the problems is that the FDA in the States just does not have the manpower available to check each and every shipment that arrives from China (one of the leading E Cigarette manufacturers), and as such getting the devices into the country will be simple enough. As well as this, users should be able to easily buy their device straight from China itself.
One E Cigarette merchant in America, Jeff Smith, stated that: “This raises serious health questions that the lack of thought on the part of the FDA and special interest has refused to come to grips with.” He continued: “What you are doing is allowing these products to ship into the country that does not have any oversight. At least with US companies, they have a chance to lose money and their reputations, and therefore you have a first line of defence on quality control, which will soon be gone as a ban takes place”
The FDA will not, therefore, be able to have virtually any control over the flow of devices from China due to its manpower issues and will, at the same time, leave themselves wide open to a rash of lawsuits from Americans who utilise the E Cigarette as an aid to help quit or reduce their potentially harmful tobacco intake. ...
